Thank you for visiting Leben Design PLLC (“Leben Design”) and our website (the “Service”). This Policy explains our online information practices and the choices you can make about the way your information is used at our Service.

All capitalized words in this Privacy Policy that are not defined in this Policy have the meaning given to them in the Terms of Service). Your privacy is important to us. 

I. Information Leben Design May Collect.   We collect, or may collect in the future, several types of information from and about users of our Services, including information:

a. By which you may be personally identified, such as your information from your government issued identification, name, address, e-mail address, and phone number and any information that the Service collects that is defined as personal information under any applicable law (“Personal Information”);

b. Financial information, such as credit card information, for Purchased Plans or when entering into an Architectural Services contract.

c. Other information that is about you but is not Personal Information;

d. About your internet connection, the equipment you use to access our Services and usage details.

II. How We Collect This Information:

a. By having you directly and voluntarily provide it to us; 

b. Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses and information collected through cookies or other tracking technologies.

III. Information That You May Provide to Us.

a. Information that you provide by filling in forms on the Service or creating an account, including financial information that you may provide relating to payment for Purchased Plans or when entering into an Architectural Services agreement for Customization Services as described in the Terms of Service.

b. Records and copies of your correspondence (including e-mail addresses), if you contact us.

c. Details of transactions you carry out through our Services and of the fulfillment of your orders. 

d. Your search history on the Services.

IV. Information We May Collect through Automatic Data Collection. As you use our Services, we may use automatic data collection technologies to collect certain information about your equipment and behavior, including:

a. Details of your visits to our Services, including location data and the resources that you access and use on the Services.

b. Information about your computer and internet connection, including your IP address, operating system and browser type.

c. We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). The information we collect automatically is statistical data and does not include Personal Information, but we may maintain it or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to estimate our audience size and usage patterns, store information about your preferences, allowing us to customize our Services according to your individual interests and recognize you when you return to our Services.

V. Technologies We May Use.  The technologies that we use for automatic data collection may include:

a. Cookies. A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Services. 

b. Web Beacons. Pages of the Site may contain small electronic files known as web beacons (also referred to as clear gifs. pixel tags and single-pixel gifs) that permit Leben Design, for example, to count users who have visited those pages or opened an e-mail and for other related statistics.

c. Google Analytics. Leben Design may use Google Analytics. Please refer to Google’s Privacy Policy for more information. You may also choose to download the Google Analytics opt-out browser add-on.

d. We do not collect Personal Information automatically, but we may tie this information to Personal Information about you that we collect from other sources or you provide to us.

VI. Third Parties. Some content on the Services, such as hyperlinks, may be served by third-parties, including advertisers and ad networks. These third parties may use data tracking technologies to collect information about you when you use our Services. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

VII. How We Use Your Information.  We may use information that we collect about you or that you provide to us, including any Personal Information:

a. To present our Services and its contents to you and notify you about changes to our Services or any products or services we offer or provide through it.

b. To provide you with information about our Services and notices about your account if you choose to create one.

c. To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including any payment issues.

d. To provide you with Purchased Plans.

e. To collect payment. You understand and agree that Leben Design does not directly process payments for Orders made through the Service, and that payment processing is performed by third parties. To facilitate this payment processing Leben Design must disclose Personal Information and financial information to such third party payment processors.

f. In any other way we may describe when you provide the information and to fulfill any purpose for which you provide it.

g. For any other purpose to which you may consent.

VIII. Disclosure of Your Information.  We may disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose Personal Information that we collect or you provide as described in this privacy policy:

a. To our subsidiaries and affiliates.

b. To contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.

c. To a successor in interest in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Leben Design’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information held by us about our Users is among the assets transferred.

d. To third parties to market their products or services to you if you have consented to these disclosures. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.

e. To fulfill the purpose for which you provide it. 

f. For any other purpose disclosed by us when you provide the information.

g. To comply with any court order, law or legal process, including to respond to any government or regulatory request.

h. To enforce or apply our Terms of Use and other agreements

IX. Your California Privacy Rights. California Civil Code Section § 1798.83 permits users of our Services that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes.
